General Rules and Regulations
1.1 Bets Confirmation/Transactions
All bets stand and null. We do not process request to change, void or cancel once your bet submission is confirmed in the system. Should any dispute arises, BK8.com and Management reserves the right of final decision.
1.2 Results and Settlement (Payout)
Results and Settlement (in abbreviation “R&S”), refer to the final outcome of your bet(s) selection and bet(s) confirmation. Refer to point 5 on terms of use . Your winnings will be credited into your account (product wallet, refer to FAQ) once your bet has been processed, resulted and settled.
Results shall be determined according to the official result website of the relevant governing body at the time of the event settlement. If there is no official result is available from the official website, the decision of the official governing body relating to the event at 24:00 hours (local time on the day of the event) shall determine the result. It will be irrelevant for betting purpose if there is disqualification or any other changes to the outcome of the event if an official result already exists.
If the result settled indifferent from the result posted on the website (example; running announcement / text on the website), BK8.com will take necessary reference from the official website to rectify the result of the particular event.
The settlement of the particular event will be hold on but no guarantees for maximum delays in the event of no result of the particular event from official website and or from governing body, BK8.com will attempt to process the results and settlement as soon as possible after event completion once the result is made officially. Where no results on or from official website are not provided, we will use independent evidence to determined the results for bet settlement. If there is uncertainty and conflicting independent evidence on the results, we will settle on the majority independent view or where applicable official league website will take priority.
BK8.com at its soles discretion and reserves the final decision to void / cancel bet totally or partly, if BK8.com reasonably believe that the result of the particular event becomes publicly known before the conclusion of the event; bets have been offered and accepted due to an error.
In the Event of uncertainty over any result then BK8 reserves the right to suspend settlement of any Market.
BK8.com and Management reserves the right of final decision on the outcome.
1.3 Scheduled Time
Your bet must be submitted and confirmed by the system before the scheduled time/allocated time that is given to you from the system. Your bet will not be accepted once the scheduled time/allocated time given is expired and the event/match/game started.
In event/match/game/market/product that is specified to accept bets after and during the event/match/game/market/product will be considered valid and accepted. Example; in Sports Betting for Live In-Running (In-Play, Betting In-Running) or any specified Betting In-Running match offers on the website.
If BK8.com reasonably believes that your bet is confirmed after the scheduled time (non-specified event/match/game /market/product that allowed to accept after the scheduled time, or in the event/match or market is not closed or suspended at the correct time, unnoticed changed of scheduled time from the official/non-official sites and other reasons) your bet is deemed void and your bet amount (stakes) shall be refunded into your account.
Refer to point 5, terms of use. Should any dispute arises, BK8.com and Management reserves the right of final decision.
The winner of an Event is determined at the conclusion of the Event for purposes of determining the winning bets regardless of the subsequent reversal of decisions or the result of any protest or appeal.
1.3.1 Periods of Time
1.3.1.1 The posted duration of an Event is for reference purposes only. Bets will be valid despite the change in scheduled duration.
1.3.1.2 Any incident during injury or stoppage time that is played, is deemed to have occurred at the end of regular time, e.g. a goal scored in first half injury time of a soccer match is deemed to have been scored on 45 minutes.
1.4 Price, Odds
During your account opening (account registration), you need to select your preferred Odds Format between Decimal, American, Malay, Hong Kong and Indo odds format. Refer to FAQ. Once this odds format is registered and you will be offer in the particular odds format, but the system shall not limit you of changing the odds format once after you have logged in into your account or from the specific product. You need to check the odds (price) before you confirm your bet. BK8.com reserves the right to correct any errors with the input of the betting odds in the particular event/match/game before and or after the event/match/game being resulted and settled. Refer to point 5 and 7, terms of use.
1.5 Change of Venue
All the related bets are deemed void only if the venue is changed to the former away team’s home venue.
All the relevant bets are deemed valid if the event is changed to another venue. This rule will only apply for events where the team has a home arena.
1.6 Auto Time Acceptance
You are given an option to place a bet using “Auto Time Acceptance” by selecting “Time Accept” button. The “Auto Time Acceptance” option may be available only on certain Event. Your bet will be auto accepted and confirmed once the indicated timer expired if no interruption on the following conditions:
You agree to accept and hold no liability to BK8.com and you agree that you are solely responsible to check and confirm on your bets acceptance and it’s at your own risk when using “Auto Time Acceptance” feature.
- If no Goal scored by any Team
- If no Red Card is awarded
- If no Penalty is awarded
- If no Technical Error or Issue, but not limited to, any failure in any telecommunication that prevents the correct placing, accepting and or recording or notification of bets, delays and interruptions in operation of transmission such as internet connectivity failure.
BK8.com reserves the final decision.
1.7 Abandoned and Postponed of Event
1.7.1 Abandoned Event
In a scenario of an event is discontinued or abandoned for any reasons, the current score at that particular time counts if the minimum requirements are fulfilled for the specific match/market/game/sport according to the specific sports rules and regulations or there is an official result or from the governing body or unless otherwise stated and all bets are deemed void. Unless the particular markets on the event with valid decisions and already decided will be deemed valid for betting purpose, example, “Half-Time” betting.
1.7.2 Postponed of Event
All bets are deemed void if the event is cancelled or postponed, which within 36 hours after the scheduled start time has not been announced or started; or within 12 hours for Baseball matches. Refer to Baseball rules.1.8 Combos and System bets
What is a system bet?
System bets are similar to accumulators or combos in that you choose several selections within one bet, but all possible combinations of bets from those selections are covered, with the advantage of winning even if not all picks are winners.
Systems bets are presented as two numbers separated by a slash: eg. 2/4, with the first number denoting the type of bets involved (in this case, doubles), and the second number denoting the number of selections involved.
For example, in a 2/4 system bet, you would choose 4 selections and click on the System tab at the top of the bet slip, where you would then see your system bets options. The 2/4 system bet is made up of the 6 possible combinations using your 4 selections, so a stake of €0.50 would cost €3. Even if only 2 of those possible combinations were winners, your bet would win, with the return amount dependant on how many possible combinations actually win. If none or only one of your picks wins, your system bet loses. When you place your system bet, the amount of winnings shown is the maximum winnings possible if all picks win.

- BK8.com is not liable for any financial loss and or bets which are concluded by third parties or any other person from using your account for wagering purpose. Texas Hold'emThe Blinds
In Hold’em, a marker called ‘the button’ or ‘the dealer button’ indicates which player is the nominal dealer for the current game. Before the game begins, the player immediately clockwise from the button posts the “small blind”, the first forced bet. The player immediately clockwise from the small blind posts the “big blind”, which is typically twice the size of the small blind, but the blinds can vary depending on the stakes and betting structure being played. In No Limit games, the games are referred to by the size of their blinds (for example, a $1/$2 Hold’em game has a small blind of $1 and a big blind of $2). Depending on the exact structure of the game, each player may also be required to post an ‘ante’ (another type of forced bet, usually smaller than either blind, posted by all players at the table) into the pot. Now, each player receives his or her two hole cards. Betting action proceeds clockwise around the table, starting with the player ‘under the gun’ (immediately clockwise from the big blind).Player Betting Options
In Hold’em, as with other forms of poker, the available actions are ‘fold’, ‘check’, ‘bet’, ‘call’ or ‘raise’. Exactly which options are available depends on the action taken by the previous players. Each poker player always has the option to fold, to discard their cards and give up any interest in the pot. If nobody has yet made a bet, then a player may either check (decline to bet, but keep their cards) or bet. If a player has bet, then subsequent players can fold, call or raise. To call is to match the amount the previous player has bet. To raise is to not only match the previous bet, but to also increase it.Pre-Flop
After seeing his or her hole cards, each player now has the option to play his or her hand by calling or raising the big blind. The action begins to the left of the big blind, which is considered a ‘live’ bet on this round. That player has the option to fold, call or raise. For example, if the big blind was $2, it would cost $2 to call, or at least $4 to raise. Action then proceeds clockwise around the table.
Note : The betting structure varies with different variations of the game. The betting structure for No Limit games are as follows
No Limit Texas Hold’em
The minimum bet in No Limit Hold’em is the same as the size of the big blind, but players can always bet as much more as they want, up to all of their chips.
Minimum raise: In No Limit Hold’em, the raise amount must be at least as much as the previous bet or raise in the same round. As an example, if the first player to act bets $5 then the second player must raise a minimum of $5 (total bet of $10).
Maximum raise: The size of your stack (your chips on the table).The Flop
Now, three cards are dealt face-up on the board. This is known as ‘the flop’. In Hold’em, the three cards on the flop are community cards, available to all players still in the hand. Betting on the flop begins with the active player immediately clockwise from the button. The betting options are similar to pre-flop, however if nobody has previously bet, players may opt to check, passing the action to the next active player clockwise.The Turn
When the betting action is completed for the flop round, the ‘turn’ is dealt face-up on the board. The turn is the fourth community card in Hold’em. Another round of betting ensues, beginning with the active player immediately clockwise from the button.The River
When betting action is completed for the turn round, the ‘river’ is dealt face-up on the board. The river is the fifth and final community card in a Hold’em game. Betting again begins with the active player immediately clockwise from the button, and the same betting rules apply as they do for the flop and turn, as explained above.The Showdown
If there is more than one remaining player when the final betting round is complete, the last person to bet or raise shows their cards, unless there was no bet on the final round in which case the player immediately clockwise from the button shows their cards first. The player with the best five-card poker hand wins the pot. In the event of identical hands, the pot will be equally divided between the players with the best hands. Hold’em rules state that all suits are equal.
After the pot is awarded, a new hand of Hold’em is ready to be played. The button now moves clockwise to the next player, blinds and antes are once again posted, and new hands are dealt to each player. -
Omaha Hi
Omaha Hi, a version of Poker for between 2-10 players, has gained popularity, due to its fast paced play and relatively simple game rules. A hand of Omaha Hi consists of up to 4 Betting Rounds. After the placing of the Blind Bets (see The Blind Bets below), each player receives four private, facedown “Pocket Cards”. Throughout the hand, five face-up “Community Board-cards” are placed in the centre of the table, to be shared by all the players. After the fourth and final Betting Round is complete, there is a “Showdown”. The player who creates the highest ranking (valued), five card, Poker hand, using any combination of two of their four Pocket Cards and any three of the five Community Board-cards, wins the Pot.
The Blind Bets
- The first player to the left of the Big Blind initiates the first Betting Round (see the Betting Rounds & Limits below). The Betting Round then proceeds, in a clockwise fashion, around the table, with each player acting in turn. In this Betting Round, each player is required to at least “Call” the Big Blind, in order to remain in the game. The Betting in this Round is set at the table’s Lower Limit Stake.
- The second player Sitting-in, in a clockwise fashion to the left of the Dealer, places the “Big Blind” Bet (equal to the table’s Lower Limit Stake).
The Pocket Cards – The First Deal
- The Dealer distributes four facedown “Pocket Cards” to each player. The cards are dealt in a clockwise fashion, one at a time, starting with the player to the left of the Big Blind.
The First Betting Round

- The first player to the left of the Big Blind initiates the first Betting Round (see the Betting Rounds & Limits below). The Betting Round then proceeds, in a clockwise fashion, around the table, with each player acting in turn. In this Betting Round, each player is required to at least “Call” the Big Blind, in order to remain in the game. The Betting in this Round is set at the table’s Lower Limit Stake.
“The Flop” – The Second Deal
- The Dealer places the first three “Community Boardcards”, face-up, in the centre of the table. These cards are shared by all the players.

- The first “active” (has not Folded) player to the left of the Dealer begins the second Betting Round. The Betting Round then proceeds, in a clockwise fashion, around the table, with each active player acting in turn. The Betting in this Round is set at the table’s Lower Limit Stake.

- The Dealer places a fourth Community Boardcard, face-up, in the centre of the table.

- The Dealer places a fifth Community Boardcard, face-up, in the centre of the table.
The Fourth and Final Betting Round
Betting Limit: Higher Limit Stake
- The first active player to the left of the Dealer begins the fourth Betting Round. The Betting Round then proceeds, in a clockwise fashion, around the table, with each active player acting in turn. The Betting in this Round is set at the table’s Higher Limit Stake
The Showdown
- Once the fourth Betting Round has been completed, there is a “Showdown” (if more than one player remains active – see The Showdown below). In the Showdown, each active player combines any combination of two of their four Pocket Cards, and any three of the five Community Boardcards, to create the highest ranking (valued), five card, Poker hand possible. The active player who creates the highest ranking Poker hand wins the Pot.

Pot Limit Poker Betting Rules
Minimum Allowable Bet/Raise/Reraise: In a Betting Round, once an initial Bet has been placed, all following players wishing to Raise/Reraise must do so in amounts equaling no less than the Round’s initial Bet. For example:
- Player one Bets: $10;
- Player two Raises: $10 (total wager: $20);
- Player three Calls: (total wager: $20);
- Player four Reraises: $10 (total wager: $30);
- Player five Calls: (total wager: $30);
- Player six Reraises: $20 (total wager: $50);
- Etc. until end of Betting Round.
Maximum Allowable Bet/Raise/Reraise:
The sum total of:- The amount of the most recent Call;
- Plus the amount of the Raise/Reraise;
- Plus the total amount currently in the Pot.
For example:
- The Betting Round begins with a total of $20 in the Pot;
- Player one Bets: $15 (total in Pot: $35);
- Player two Calls: $15 (total in Pot: $50);
- Player three Raises Pot Limit: $80 (= Call: $15 + Raise: $15 + Current Pot: $50) (total in Pot: $130);
- Player four Calls: $80 (total in Pot: $210 Pot);
- Etc. until end of Betting Round
There are no caps to the Betting Rounds. A Betting Round ends only when each active player has either: Folded, Checked or Called the most recent Raise/Reraise to the Pot, in turn.Enjoy the tables and good luck!

Sit & Go
A Sit & Go tournament is an impromptu poker tournament for up to 50 players. To learn how to join a Sit & Go tournaments, please see Join a Tournament, in the Getting Started section of this site. Members may register to a maximum of six poker tournaments and actively play in two poker tournaments at a time.
A Sit & Go tournament commences once the predetermined number of players have registered. Participants will be required to buy in, upon joining the tournament. A Sit & Go tournament buy-in varies depending on the tournament. Participants will also be required to pay a tournament fee. Many tournaments offer rebuys and add-ons at certain points.
Once the tournament is about to begin, players will be seated at the tournament tables, in a random manner. At each tournament table there will then be an initial draw to determine, according to highest ranking card (by suit), which player will act first as dealer.
If the Sit & Go tournaments is being played on more than one poker table, active players may be moved between the tables, as the tournament progresses and players are disqualified (run out of chips).
Tournament blinds will increase as the tournament progresses, according to a predetermined schedule. This stake increase schedule is available in the tournament Lobby (please see Guide to the Tournament Lobby, in the Our Software section of this site). There are no recesses during Sit & Go tournaments.
If, for technical reasons, the tournament is canceled in the middle, participants who have already been eliminated will lose their buy-ins and entry fees. The remaining players will be refunded their buy-ins and entry fees, and will equally divide up the buy-ins of the players already eliminated (regardless of the chip standing when the tournament was halted).
The last remaining player in the tournament (has won all the chips) is the winner. -
Tournament
These rules apply to tournaments at BK8. The Tournament Rules as listed here are intended to complement the Terms of Service, not replace them. In the event of a discrepancy between the Tournament Rules and Terms of Service, the Terms of Service shall take precedence
General
- BK8 will at all times consider the best interests of the game and fairness as the top priority in the decision-making process. Unusual circumstances can on occasion dictate that decisions in the interest of fairness take priority over the technical rules.
- All tournaments will begin promptly at the scheduled time stated in the Tournament Lobby. BK8 reserves the right to delay or cancel a tournament without prior notice.
- Important information about each tournament, including the blind structure, length of rounds, rebuy and break information, can be found in the tournament lobby. BK8 reserves the right to change the parameters of any tournament at any time without notice.
- Seats are assigned at random. Seat changes are not permitted.
- The button will be positioned at Seat 1 to start play.
- A bet and three raises are permitted in Fixed Limit tournaments. There is no limit to the number of raises permitted in Pot Limit and No Limit tournaments.
- Prizes will be awarded as stated in the Tournament Lobby. Which prize structure is used depends on several factors including the number of entrants and the number of players per table. The prize structure is not finalized until registration has closed and the rebuy and/or add-on period is over.
- In order to be eligible to rebuy in a rebuy tournament, you must have the funds available in your account. Players without sufficient funds remaining in their account will be eliminated from the tournament. Funds currently in play in other games, or held in a currency not matching the tournament currency are not considered to be available.
- Late Registration: Late Registration is available in most tournaments. The length of the late registration period varies, but will always be shown in the Tournament Lobby. Late registration time is based on blind level. For example, players can late register until “blind level 6” for a certain tournament
Please note that players are only allowed to participate in a tournament once, unless re-entry is permitted, as specified in the tournament lobby. One player using multiple accounts to enter multiple times into a single tournament is not permitted, and may result in penalties including a warning, disqualification from the tournament (with partial or full forfeiture of winnings), and barring from BK8. - Unregistration: Most tournaments allow unregistration until a few minutes before the event begins.
Eliminations
- Most tournaments end when one player accumulates all the chips in play, or when all remaining players will receive the same prize (for example, if the tournament awards five identical prizes, the tournament may end when there are five players left).
- If two or more players are eliminated on the same hand, a player with more chips at the start of the hand finishes higher than a player with fewer chips. If all players started the hand with an identical number of chips, all players tie for that rank, and any prizes due to those players will be equally distributed between them.
- BK8 uses a ‘forward-moving button’ rule in its tournaments. According to this rule, no player ever receives the button twice in a row; at the completion of every hand, the button is moved clockwise. The implication of this rule is that when players are eliminated, there may be players who get a reprieve from one or both blinds. Since these are basically random occurrences, no player will receive any long-term advantage, and the rule is necessarily fair for all players.
- When two players remain at the final table, the button will post the small blind, and act first on the opening round.
- As players are eliminated from the tournament, the software will “break” tables to fill available empty seats. The re-seating of players at broken tables is performed randomly and, although rare, may result in a player having to post multiple big blinds in a row. On occasion, the software may balance tables.
Breaks
- The break schedule for a tournament can be found in the ‘Tournament Info’ dialog, which can be opened from the tournament lobby. Players are encouraged to study the break schedule for each tournament they wish to play, as break length and timing may vary from one event to the next. BK8 offers two varieties of breaks:
- Tournaments with synchronized breaks will go on break at 55 minutes past the hour. For example, a tournament which begins at 07:25 will go on break at 07:55, 08:55, 09:55 and every hour thereafter until the tournament ends.
Tournaments of this type can be identified by the phrase ‘The tournament goes on break at 55 minutes past the hour’, found in the main lobby information panel. - Other tournaments will go on break between levels. For example, a tournament beginning at level 1 may go on break after level 2
- In all cases, the tournament will wait for hands at all tables to complete before the break period begins. This means that at some tables, the break will last slightly longer than at other tables.
Note that not all tournaments offer breaks (for example, Hyper-Turbo and some Heads-Up or Shootout-style events).
- Tournaments with synchronized breaks will go on break at 55 minutes past the hour. For example, a tournament which begins at 07:25 will go on break at 07:55, 08:55, 09:55 and every hour thereafter until the tournament ends.
Disconnects and Sitting Out
- By participating in a tournament, a player accepts the risk of Internet disconnection, due to problems with the connection between their computer and the servers, lag or freeze or some other problem in the player’s computer or the Internet.
- BK8 does not accept any responsibility for a player disconnect except in the case of a server crash.
- If a player times out during a hand, whether connected or disconnected, his or her hand will be folded if facing action, or may be checked if facing no action.
- If a player is not connected before a hand starts, he or she will be dealt cards, and a blind and/or antes will be posted. There is no rule against a single player choosing to sit out; the player doing so will continue to have blinds and antes posted and cards dealt. Two or more players may not make any agreement to sit out simultaneously, whether at the same table or different tables.
Unethical Play
- Poker is an individual (not a team) game. Any action or chat intended to help another player is unethical and is prohibited. Unethical play, such as soft-play (playing less aggressively against a partner) and chip dumping (intentionally losing chips to a partner), may result in penalties, including seizure of funds from the offender’s account and/or termination of the account. BK8 routinely reviews game play to look for violations of our rules and to ensure the integrity of our games. It may be necessary to withhold player winnings until the completion of game play reviews.
- With some exceptions (described below), a player may play on only one account during a tournament and may not ‘hand off’ his seat in mid-event to a different player. Violation of this rule may result in penalties including a warning, disqualification from the tournament (with partial or full forfeiture of winnings), and barring from BK8.
Examples of permissible exceptions that we give below are intended to describe examples of unplanned but serious events which are beyond your control.
Examples of things which are not beyond your control and therefore prohibited include:- Going to bed and letting someone else finish the tournament.
- Entering a tournament then getting on an airplane, or embarking on any other pre-planned trip, while asking a friend to play your account while you change location.
- Deciding that it would be fun to finish the Sunday Million at Joe’s house then asking Joe to take over your account, while you make the 30-minute trip to his house.
- You and a friend are playing in the same tournament. You agree that if he busts out before you do, he will take over playing your account.
- Your husband is out of town for the weekend, but gives you his password. You log into both his account and yours and play both accounts in the same tournament.
- You have progressed to the final few tables of a tournament and somebody offers you cash equity for your seat. You allow the other player to sign into your account, or you continue to finish the tournament following the explicit instructions given by him.Examples of things which are beyond your control and therefore allowed, subject to BK8 being able to corroborate with evidence, include:

- A thunderstorm strikes your location and takes the power down for the surrounding area, so you call a friend to take over your account while you make alternative arrangements.
- Your child is taken ill and you have to attend hospital, so you call a friend to take over your account.
- You are playing in a tournament and lose internet access in your home due to a failure of your ISP. You call a friend and he takes over while you make alternative arrangements.
Server Issues
- In the event of a server crash, the hands in progress at every table will be restored by rolling back those hands. Each player’s chip count will be reset to the amount at the beginning of the hand. In special circumstances, when a tournament needs to be cancelled because of a crash or some other reason, players will be compensated according BK8’s policies.
Bounties
In some specially designated tournaments, a cash ‘bounty’ will be placed on some or all of the tournament participants. A player who eliminates such an opponent wins the cash bounty.
There are four types of Bounty Tournament:
Knockout: A bounty is placed on every entrant. You win a cash prize for each opponent you eliminate.
Progressive Knockout: When you knock a player out of the tournament, part of the bounty is awarded at that time, and the rest of the bounty is added to the bounty on yourself. The amount of bounty on each player is displayed at their seat.
Fixed Bounty: A bounty is placed on a specific player in the tournament.- The bounty is awarded to the player who wins the ‘relevant pot’ for the hand in question, which may be the main pot or one of several side pots. ‘Relevant pot’ means the pot in which the bounty player was all-in for their final chips.
- For example:
Daniel (100 chips), Barry (200 chips), Vicky (400 chips), and Julian (1000 chips), are playing a hand in a No-Limit tournament.
Daniel moves all-in, and Barry, Vicky and Julian call. The pot which Daniel is eligible for is known as the ‘main pot’. Betting continues ‘on the side’, in side pot 1.
Barry moves all-in, and Vicky and Julian call. Betting continues between Vicky and Julian in side pot 2.
Vicky moves all-in, and Julian calls. Barry shows the best hand. He wins side pot 1 and the main pot, eliminating Daniel. He receives the bounty for Daniel.
Julian shows the next best hand, and wins side pot 2, eliminating Vicky. Julian wins the bounty for Vicky.
Note that although Barry had the best hand overall, he didn’t have as many chips as Vicky and therefore could not eliminate her. Julian however did have enough chips, and therefore wins Vicky’s bounty.
- For example:
- In the event that two players show identical winning hands and therefore split the ‘relevant pot’, any bounty awarded will be divided equally between the winners. Odd cents will be awarded in turn to the players in the earliest positions.
- If a bounty player wins the tournament:
- In a Knockout tournament, the player is awarded their own bounty.
- In a Team Pro or Fixed Bounty tournament in which the Team Pro or Fixed bounty player wins, the bounty is not awarded.
- If a tournament advertises a bounty on a particular player, but that player does not register for the tournament, no bounty will be paid for that player.
- Players may not make any agreement amongst themselves to eliminate a particular player in order to claim their bounty award. Such agreements are considered collusion, and are grounds for disqualification from the tournament or other penalties.
In case of disputes, BK8 management’s decision will be final.

This end user agreement (the “Agreement”) is a legal agreement between You (“You”) and BK8, and its affiliated corporations, successors and assigns (collectively referred to herein as “BK8”). The software (the “Software”) and gaming services (the “Gaming Services”) are being are provided to You by BK8 on an “AS IS” basis, for Your personal use only. Please note that the Software and Gaming Services are NOT FOR USE BY PERSONS UNDER 18 YEARS OF AGE. No one under the age of 18 years is permitted to wager or participate in the activities, games, Software and Gaming Services (also collectively referred to herein as the “Services”) at BK8, nor residents in Countries where the Services are prohibited. If it comes to BK8’s attention through reliable means that a registered user is a person under 18 years of age or is otherwise not permitted to use the Services, BK8 will, among other recourses available to it, cancel that user’s account.
This Agreement shall apply to any use of the Services. In case of contradiction between a provision of this Agreement and any provision on the BK8 web site, the provision of this Agreement shall prevail. Unless otherwise indicated herein to the contrary, any reference made in this Agreement to BK8 shall be deemed to have been made to BK8, and its affiliated corporations, successors and assigns.
These terms and conditions, together with the BK8 Tournament Rules, Poker Rules sections, all game rules, the Disconnection and Cancellation Policy, and any other additional rules, policies and terms on BK8.com that specifically relate to and govern any particular event, game, software or tournament constitute a legally binding agreement (‘Agreement’). If this agreement is translated, the English language text shall prevail. Any other document provided in connection with this agreement shall be in English or there shall be a properly prepared translation into English and the English translation shall prevail in the case of any conflict between them.
SOFTWARE
SOFTWARE LICENSE: BK8 grants You a personal, non-exclusive, non-transferable license to use the Software, but retains all proprietary rights to the Software. All rights not specifically granted under this Agreement are reserved by BK8 and, as applicable,BK8’s licensors. The Software is licensed for Your personal use only. Your license confers no title or ownership in the Software and should not be construed as a sale of any rights in the Software.OWNERSHIP OF SOFTWARE: All right, title and interest and intellectual property rights in the Software are owned by BK8 or its licensors, and may be protected by applicable copyright or other intellectual property and gaming laws and treaties. All rights not expressly granted under this Agreement are reserved by BK8.
USE OF SOFTWARE: You may only use the Software in accordance with this Agreement. You may install the software or any other components of the Services on any additional personal computers. You may make back-up copies of the software provided that such use and backup copying is only for Your own personal use in accordance with this Agreement, and further, that such installation and use is made through a computer of which You are the primary user. You may only use one instance of the software on one computer at any time. You are not permitted to play at the same table or in the same tournament using multiple accounts from the same computer hardware and doing such will be a direct violation of this agreement.
SOFTWARE LIMITATIONS: The Software contains copyrighted materials, trade secrets and other proprietary material. You acknowledge that the Software in source code form remains a confidential trade secret of BK8. You may not reverse engineer, decompile, modify, publicly display, prepare derivative works based on, disassemble, or otherwise reproduce or provide others with the Software. You may not sell, assign, sublicense, rent, lease, lend, or directly or indirectly transfer the Software to any third party. Any assignment in violation of this Agreement is void.
CHANGES IN SOFTWARE FUNCTIONALITY: By accepting the terms of this Agreement, You agree that BK8 is permitted to limit, deny, update or cancel some or all of the functionality of this Software at any time, without prior notice. You agree to bear the risks of and hold BK8 harmless for any and all effects that a change in functionality may have on Your ability to use the Software. BK8 may require, as a condition to Your continued access to BK8’s services, Your acceptance of Software improvements, corrections, adaptations, conversions to more recent Software versions or any other changes to the Software.
INFORMATION EXTRACTION: BK8 reserves the right to collect information about the computer You are using to run the Software for two specific reasons only:
To ensure that You are not using any software prohibited by section 10 herein.
To determine the configuration of Your computer for our analysis of the usability of the software and/or error tracking.
BK8 will not collect any other information about Your computer or Your use of it other than provided for in this Agreement and BK8 will not share the information it does collect with any third party.TERMS OF SERVICE
ACCEPTANCE OF TERMS: BK8 permits You to use or play its Services, subject to the terms of this Agreement. Please read them carefully. By registering and opening an account as contemplated by section 7 below, You are certifying that You agree to be bound by the terms of this Agreement. If You do not wish to be bound by these terms, You must not register and open an account, and You will be unable to access or use the Services. The terms of this Agreement may be changed or updated at any time by BK8, without any notice to You. Your continued access to, and use of, the Services will mean that You agree to be bound by the most current version of this Agreement. You can review the most current version of this Agreement at any time at Terms of Service.
REGISTRATION: To use BK8’s services, You must first open an account by entering a unique and valid user name and associated password. You agree to provide only true and current information and You further agree to update this information as necessary to keep it true and up-to-date. You also agree to allow the BK8 software to take a digital fingerprint of Your computer for security reasons. The fingerprint comprises of a set of numbers including IP configuration which is stored along with Your account information. When opening a play money account at BK8, You will be able to access the following: play money games, play money tournaments. With a real money account, You can access real money games and real money tournaments. BK8 reserves the right to suspend, modify, remove and/or add any Game in its sole discretion with immediate effect and without notice and BK8 will not be liable for any such action.
PERSONAL USE OF GAMING SERVICES: You agree to keep Your account information secret and confidential and to not allow anyone else to use or have access to it. Any participation in the games is at Your sole choice, discretion and risk. By playing at BK8, You agree that You do not find the Services or other aspects of BK8 to be offensive, objectionable, unfair or indecent. You are only allowed to wager for Your own personal entertainment. Any commercial use of BK8 is strictly forbidden. You agree that you are responsible for verifying and abiding by the laws governing gambling in the place where the Software is used and that BK8 is not able to verify the legality of Service in each jurisdiction and it is Your responsibility to verify such matter.
ROBOTS, ARTIFICIAL INTELLIGENCE AND OTHER SYSTEMS: It is strictly forbidden to use any automated software or computer system to play at BK8, including the action of sending information from Your computer to another computer where such software or system is active. Poker-Robots or any software designed to play automatically at poker sites is not allowed. At any time while You are playing at BK8, the Software may scan Your computer for any activity of such software and systems. Also forbidden is the use of any software during the game that is designed to track and display the actions of the other players on the site or any system or service to transfer funds to or from a player’s BK8 account to their account at any other site or the deliberate “dumping” of chips between any accounts on the BK8 Poker Network. It is also strictly forbidden to use any programs which display the playing history, statistics, or tendencies of other players on the BK8 Poker Network, other than systems where:
Hand histories obtained by the User him/herself via their own play is used. Users cannot import hands.
Hand histories which were obtained from opponents with the screen name which matches the screen name which was used while the hands were actually played.Note: the data collection of playing history, statistics or tendencies of other players is confined to playing sessions where an opposing player is using a unique screen name and which also do not retain any data after the specific user name is no longer used by the opposing player.
Use by players of external player assistance programs which are designed to provide players with an unfair advantage over their opponents are expressly prohibited. BK8 defines external player assistance programs as computer software and non-software-based databases or profiles and deems access to or the ability to gather data or information on other players by any means that would not be accessible via their own first-hand experience to be “unfair”. Usage of such methods will result in the closing of Your account and be subject to confiscation of Your winnings and funds. BK8 reserves the right to publicize information of any such documented abuse including Your personal information.PLAY MONEY: Play money is not real (bona fide) money and is kept separate from real money. Play money does not constitute or represent any value whatsoever. Play money can only be used for playing at play money tables and cannot be collected, cashed out or in any other way be made into or transferred between WIN CAKE and You or any other person or legal entity
SECURITY CHECKS, REVIEWS AND RELEASES: BK8 reserves the right to verify Your identity and the fidelity of the information You have supplied by making various security and ID checks. If You fail or refuse on request to comply and sign a security request from BK8, BK8 reserves the right to void Your account.
ABANDONMENT OF ACCOUNT BALANCE: If You do not access Your BK8 account by “logging in” to Your account using Your user name and password for a period of three hundred and sixty five (365) days, Your account will be closed and the entire Account Balance and all promotional items including all of Your BK8 bonuses will be deemed abandoned and forfeited; provided however, that this requirement for login and entry is not and does not constitute any condition whatsoever for You to play any game, deposit funds or participate in any activity at BK8other than logging in.
OPERATION OF ACCOUNTS: During the term of Your Account, there may be circumstances which require changes to Your Account.
Succession: In the event of Your death or permanent incapacity, BK8 requires a copy of the death certificate or a registered medical physician’s statement and any other documents relating to administration or guardianship of Your estate as proof of Your successor’s or guardian’s (jointly referred to as “Beneficiaries”) entitlement. In this event, any of Your income rights and/or the value of Your Account may be passed to Your Beneficiaries. Your Beneficiaries must submit a written application supported by the necessary documentation including a death certificate or registered medical physician’s statement, for consideration by BK8. Approval of this application shall not be unreasonably withheld. Transfers will only be approved if the Beneficiaries agree to assume Your account responsibilities and obligations as outlined in these Terms & Conditions. If a Beneficiary is not permitted to hold an account, the Beneficiary will be entitled to transfer Your interest in the account to a third party who is entitled to hold a BK8 account.Self Exclusion: BK8 reserves the right to monitor Your account activities and notify You if BK8 believes You may have gambling problems. However, BK8 makes no warranties about its ability to identify and help You with gambling problems. You may request to be excluded from entering or using the BK8 Services for various reasons and may do so at any time by sending a request to [email protected].
Suspensions and Termination of Account: BK8 reserves the right to terminate Your account at any time if You breach any of the Terms of Service; or provide any false or misleading information to BK8; or partake in fraudulent, inappropriate or offensive behavior against BK8 or any other BK8 user; or are involved in an activity which may be deemed contrary to accepted standards of fair dealing, in breach of laws applicable in Your jurisdiction and/or contrary to the interests of BK8 or injurious to BK8’s reputation. Such termination shall be made by BK8 in its absolute discretion however; the actions which may be taken by BK8 in the event that you engage in such conduct can include, but are not limited to warnings, temporary suspension of BK8 Services and, temporary suspension of your BK8 account.The termination of your BK8 account will only be considered in the case of the most serious violations or, as a result of multiple violations and where possible, only after repeated communication with you. In the event of the termination of your BK8 account BK8 shall be entitled to take such action as it sees fit, including immediately blocking access to the BK8 Gaming Services, seizing all monies held in your real money account, disclosing such information (including your identity) to banks, credit card companies and/or any person or entity that has the legal right to such information, and/or taking legal action against you. a. Your right to make any representations regarding BK8 in any way whatsoever is immediately revoked;
b. Your right to use the BK8 Services, Your User Account and Password are immediately revoked;
c. You must destroy/delete all of Your copies of the Software;
d. Your right to any present or future entitlements You might otherwise have or have had arising from BK8 or Your use of the BK8 Services, as of the date of termination is revoked;
e. All other rights under these Terms of Service are terminated.
Restrictions on Chat:
You should not chat about a hand while it is in progress.
You should not use chat to offer advice to another player during a hand, or urge a player to take a particular course of action.
You should not chat about any folded cards you held during a hand or any current cards you are holding during a hand..
You should not use foul, abusive or threatening language.
The above actions are discouraged as they show poor poker etiquette and can result in chat suspension or in severe and continuous breaches a complete chat ban or account closure.DISCLOSURE TO THIRD PARTIES: You agree to keep Your account and related information secret and confidential and to not allow anyone else to use it. If You intentionally or unintentionally, directly or indirectly, disclose user name and/or password to another person, and such disclosure results in a third party participating in the BK8 Service using Your user name and password, such participation will be invalid, and You will not be refunded any resulting losses at BK8, regardless of whether or not the third party had Your consent or not. The company shall not be required to maintain e-mail or passwords if You misplace, forget or lose this data or are otherwise unable to enter BK8 because of anything other than the company’s error.
INDEMNIFICATION: You agree to indemnify, defend and hold harmless BK8, and its parents, subsidiaries, affiliates, officers, directors,shareholders, employees, agents, licensors, and partners from any and all claims, losses, liabilities, demands, damages, costs, or expenses (including reasonable attorney’s fees), arising from or asserted by any third party relating in any way to (a) Your use of the BK8 Services, or any other product, service or promotion offered to You by BK8; (b) any claim of infringement of third party intellectual property rights; (c) uploading, posting, emailing, reproducing, transmitting or otherwise distributing any Content or other materials by You; or (d) the breach of any of these Terms of Service by You or any users of Your account with BK8. BK8 reserves the right to assume the exclusive defense and control of any matter subject to indemnification by You, which shall not excuse Your indemnity obligations.
ABUSIVE OR OFFENSIVE LANGUAGE: Abusive or offensive language will not be tolerated in the BK8 Service or with the BK8 staff. Any violation of this policy will result in a suspension of playing privileges or such other actionas may be required by BK8 to ensure compliance. You are not permitted to use inappropriate or offensive language in connection with your user name and/or player ID which includes, but is not limited to profane, sexist or racist language. BK8 reserves the right to make changes to any Users name or player ID that violates this policy and to take any steps in deems appropriate, up to and including closing Your account. If You create an account with an offensive user name and/or player ID or change your existing user name/ID to an offensive one you may have Your user name/ID changed and locked and the ability to change Your user name and/or playerID will be revoked.
DISCLOSURE OF FRAUDULENT ACTIVITIES: If, at BK8’s sole determination, You are found to have cheated or attempted to defraud BK8 in anyway including but not limited to game manipulation, chip dumping, transfers or payment fraud, or if You make untrue and/or malicious comments with regard to the company’s operation in any media or forum, the company reserves the right to publicize Your actions as well as to circulate this information to other online gaming sites, banks, credit card companies, and appropriate agencies. Further, the company may close any accounts, and forfeit account balances, that You have at BK8 or at any other BK8 related website and/or business.
SETTLEMENT OF DISPUTES: You fully accept and agree that the random number generator (“RNG”) will determine the outcome of the games or other promotions that utilize the “RNG”. Further, in the event of a discrepancy between the result showing on the software and the gaming server, the result showing on the gaming server shall be the official and governing result of the game. Moreover, You understand and agree that the BK8 records shall be the final authority in determining the terms of Your participation in BK8, the activity resulting from there and the circumstances in which they occurred.
NOTICES: If You have any dispute with regard to any outcome in the games or other activity at BK8, You must submit Your complaint to BK8 in writing within fourteen (14) days of the incident by E-mail to [email protected].
COPYRIGHT AND TRADEMARKS: “BK8”, the “BK8 logo”, other BK8 logos, custom graphics and button icons are trade names, service marks or trademarks of BK8 or its affiliates. All other trademarks, trade names and service marks on the Site are the property of their respective owners (the “Other Marks”). Without BK8’s prior permission or the prior permission of the owners, You agree not to display or use in any manner, the BK8 Marks or the Other Marks.
GOVERNING LAW: This agreement shall be governed by and construed in accordance with the laws of First Cagayan without giving effect to conflicts of law principles. The parties submit to the exclusive jurisdiction of First Cagayan for the settlement of any disputes arising out of concerning this agreement. This agreement will not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. If any part of this agreement is found void and unenforceable, it will not affect the validity of the balance of the agreement, which shall remain valid and enforceable according to its terms.
TAXES: You are solely responsible for reporting and paying any taxes as required by the governing law of your country of residence.
GAME RULES AND RAKE STRUCTURE: You can view BK8’s game rules and rake structure at BK8.com. BK8 reserves the right to change or update the game rules and rake structure at any time, without any notice to You.
TERMINATION: This Agreement is effective upon Your first use of the Software and shall continue until revoked by BK8, until You breach any term hereof, or until You discontinue Your use of BK8’s Services. This Agreement will terminate immediately if You fail to comply with any provision of this Agreement.
DISCLAIMER OF WARRANTIES:
a. your use of the BK8 services is at your own risk. BK8 is provided on an “as is” and” as available” basis. to the fullest extent permitted by applicable law, BK8, its officers, directors, employees, shareholders, parents, subsidiaries, affiliates, licensors, and agents hereby expressly disclaim any and all representations and warranties of every kind, whether express or implied, regarding the services, its content, and any information or other materials provided by BK8 in connection with use of the services, including, but not limited to, warranties of merchantability, fitness for a particular purpose, non-infringement and those warranties arising by law, statute, usage of trade, or course of dealing.b. BK8 makes no warranty that (i) the services will meet your requirements; (ii) the services will be uninterrupted, timely, accurate or error-free; or(iii) the servers that make BK8’s service available are free of viruses or other harmful components and any errors in our software will be corrected.
c. the security mechanisms incorporated into the services have inherent limitations and you acknowledge and agree that any material and/or data downloaded or otherwise obtained through use of win cake services is done at your own discretion and risk and that you will be solely responsible for any damages to your computer system and any other property item or loss of data that results from any such activity.
d. the disclaimers contained in this paragraph are a material part of our agreement to provide the site to you.
e. some jurisdictions do not allow the exclusion of implied warranties. accordingly, some of the above exclusions may not apply to you.
LIMITATIONS OF LIABILITY: to the fullest extent permitted by applicable law, under no circumstances, shall BK8 or its officers, directors, employees, shareholders, parents, subsidiaries, affiliates, agents, partners, or licensors, be liable for any injury, loss, claim, damage or any indirect, incidental, special, punitive or consequential damages of any kind, or any damages whatsoever, including, without limitation, damages for loss of income, use, data, goodwill or other intangibles, whether or not advised of the possibility of such damages, and on any theory of liability (including negligence), arising out of or in connection with:
a. your use or inability to use the services;
b. goods, data, or services received through or advertised on the BK8 site;
c. information received through the BK8 site;
d. mistakes, omissions, interruptions, suspension, termination, deletion of files or email, damages to computer systems or equipment or other property, unauthorized access to or alteration of your transmissions or data, errors, defects, viruses, delays in operation or transmission, or any failure of performance with respect to the site, including, without limitation, those that result from acts of god, communication failures, theft, destruction, or unauthorized access to BK8’s records, programs or services;
e. statements or conduct of any third party on the BK8 service; or
f. any other matter relating to the BK8 service.
if you are dissatisfied with the service or the content available thereon, or with any of these terms of service, your only remedy is to discontinue using this services. the limitations of liability contained herein are a material part of our agreement to provide the site to you.
Notwithstanding the foregoing, if BK8 or its officers, directors, employees, shareholders, parents, subsidiaries, affiliates, agents, partners or licensors should be found liable for any loss or damage which arises out of or is in any way connected to the Site, the liability of BK8, or its officers, directors, employees, shareholders, parents, subsidiaries, affiliates, agents, partners or licensors shall in no event exceed, in the aggregate, U.S. $50.00.

LOSS OR CORRUPTION OF DATA AND DAMAGE TO COMPUTER EQUIPMENT: BK8 shall not be responsible or liable for any loss or corruption of data or Content that You may experience while using the Service or otherwise. This includes, without limitation, the loss or corruption of data or Content resulting from a) network, system, or server “crashes” or outages, or other power outages; c) damage caused by viruses, worms, or security breaches, file corruption; and d) any other cause. BK8 assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect Your computer equipment or other property on account of Your access to, or use of, BK8’s Services.
MISCELLANEOUS:
a. These Terms of Service constitute the entire agreement between You and BK8 and govern Your use of the Site, superseding any prior agreements, if any, between You and BK8, including, without limitation, any prior versions of these Terms of Service.b. You agree that no joint venture, partnership, employment, or agency relationship exists between You and BK8 as a result of the Terms of Service or use of the Site.
c. The failure of BK8 to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver or relinquishment of such right or provision, or any other right or provision.
d. If any part of the Terms of Service is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Terms of Service shall continue in effect.
